Lower Courts Bill, 2022 – comments invited


The Department of Justice and Constitutional Development published the Lower Courts Bill, 2022 for comments at https://www.justice.gov.za/legislation/invitations/20220429-LowerCourtsBill-MagistratesBill.pdf


The background note published with the Bill provides the following information:


“2.1 The purpose of the Bill is to provide for the establishment, composition and functioning of Lower Courts comprising of Regional Courts, District Courts and Municipal Courts; to make provision for the administration of the judicial functions of the Lower Courts; and to provide for matters incidental thereto.

2.2 The main aim of the Bill is to replace the provisions relating to the Magistrates’ Courts, referred to in section 166(d) and 170 of the Constitution of the Republic of South Africa, 1996, in order to renew and align the legislative framework for those courts with the needs and requirements of the modern South African society.”


Comments on the Bill must be submitted no later than Wednesday, 15 June 2022.
