National Forests Amendment Act 1 of 2022



The National Forest Amendment Act 1 of 2022 was published on 1 July 2022 in government gazette number 46650. The Amendment Act will come into effect on a date to be proclaimed by the President in the government gazette. A copy of the Act is available at:

The purpose of the Amendment Act is:

“To amend the National Forests Act, 1998, so as to provide for clear definitions of natural forests and woodlands; to provide for public trusteeship of the nation’s forestry resources; to increase the promotion and enforcement of sustainable forest management; to increase the measures provided for in the Act to control and remedy deforestation; to provide for appeals against decisions taken under delegated powers and duties; to reinforce offences and penalties; and to provide for matters connected therewith."


When the Amendment Act takes effect, the following sections of the National Forests Act 84 of 1998 will be amended:

Amendment of sections 2, 7, 8, 14, 15, 17, 23, 34, 35, 36, 37, 47, 62, 63, 65

Insertion of section 2A: Public trusteeship of nation’s forestry resources

Insertion of chapter 6A: Appeal

Substitution of section 61 with s 61: Offences relating to sustainable forest management
