ATTORNEY ALERT: 4 AUGUST 2025

Monday's edition references the Government Gazette notices announcing the phased national rollout of the Administrative Adjudication of Road Traffic Offences (AARTO) system, including the demerit points component, were published on 1 August 2025 under the following Proclamations:

Commencement dates:

(a)  1 December 2025: Sections 17, 18, 19, 19A, 19B, 20, 23, 29–35 of the Act come into effect in municipalities listed in Annexure A.

(b) 1 April 2026: Sections 17, 18, 19, 19A, 19B, 20, 23, 29–35 of the Act come into effect in municipalities listed in Annexure B.

(c) 1 September 2026: Sections 24–28 of the Act come into operation.

Commencement dates:

(a) 1 December 2025: The Act comes into effect (excluding s 2(g)) in the areas listed in Annexure A.

(b) 1 April 2026: The Act comes into effect (excluding section 2(g)) in the areas listed in Annexure B.

(c) 1 September 2026: Section 2(g) comes into operation.

 

Notices of intention to introduce three distinct Bills, each titled Constitution Twenty-Second Amendment Bill, 2025, were gazetted over the past two weeks. While each Bill proposes a unique constitutional amendment, the reference numbers remain provisional and will be confirmed upon formal introduction to Parliament. A summary of each Bill is provided below:

  • Eligibility restrictions (GN3405 GG 53099 p83 1Aug2025): Proposes expanding the categories of individuals disqualified from serving in the National Assembly, provincial legislatures and municipal councils.

  • Executive reform (GenN3385 GG 53038 p126 25Jul2025): Aims to abolish the office of Deputy Minister, introduce parliamentary oversight of ministerial appointments and empower the National Assembly to pass motions of no confidence in individual Ministers, thereby improving governance and protecting public finances.

  • Land reform (GenN3400 GG 53086 p3 28Jul2025): Seeks to amend section 25 of the Constitution to allow land expropriation without compensation, affirm collective ownership of land and natural resources, extend the restitution cut-off date to 1652 and establish custodianship under the democratic state and traditional authorities.
